Contrary to popular belief, a work permit, employment authorization document, or EAD, does not give its holder legal permission to be present in the U.S. A work permit simply allows a person to accept work during the time an application is pending.
Applicants for a work permit must have a current case or underlying application already in process with the United States Customs and Immigration Service (USCIS). Common applications where work permits may be granted include:
Merely filing a visa petition - Form I-130 or Form I-140 - does not entitle a person to work authorization. It is only when an application to adjust status (Form I-485) or an application for other benefits - such as TPS or NACARA - is filed that a person is eligible for work authorization.
Temporary visa holders may not be entitled to work during their stay in the U.S. Accepting employment may violate the terms of your visa and could lead to deportation or interfere with your eligibility for adjustment of status at a later date.
Applying for a Work Permit

Work permit applications take about 90 days to process at USCIS. Annual renewals should be sent 90 days before the expiration of your current work permit in order to ensure the renewal is granted in time.
