What are the grounds for asylum?
You must have been persecuted in the past, or fear future persecution because of your race, religion, nationality, membership in a particular social group, or political opinion.
Claims can also be based on sexual identity/preference, domestic violence, honor killings, statelessness, family relationships, and several other scenarios. A good asylum attorney will stay updated about the different types of asylum cases that have been granted, so clients may take advantage of new parameters.

May I apply for asylum with the United States if I am in another country?
Yes and no. You may apply for "refugee status" if you are in another country. The requirements are basically the same. This entitles you to enter the United States as a refugee. You may apply abroad with a USCIS officer, or a U.S. consulate. Once admitted to the U.S., a refugee may adjust status to that of a permanent resident after one year.
What if I have a criminal record ?
A criminal record may be a problem. If it is serious enough, you may be ineligible for asylum/refugee status. In these instances, Withholding of Removal may be available, as well as relief under the Convention Against Torture. Less serious criminal records could still cause a problem, as they may hinder a person from adjusting status to permanent residency in the future.
